Who is responsible when common property in a strata scheme is defective or causes damage to an individual lot? In this video, Damin Murdock, Principal Lawyer at Leo Lawyers, explains the Owners Corporation's duty to maintain and repair common property under section 106 of the Strata Schemes Management Act 2015 (NSW). The video examines why the obligation under section 106 is effectively a strict duty, meaning an Owners Corporation may not avoid responsibility simply by showing that it has taken reasonable steps or made attempts to repair the problem. Whether the issue involves water ingress, failed waterproofing, façade defects, deterioration of common property, or another strata building defect, understanding the evidence required and the remedies available can make a significant difference in a strata dispute. If you require advice regarding a strata dispute, common property defects, NCAT proceedings, or an Owners Corporation's repair obligations, contact Leo Lawyers using the details below. Can a builder recover the reasonable value of work completed after a building contract is terminated? In this video, Damin Murdock, Principal Lawyer at Leo Lawyers, examines the Victorian Court of Appeal decision in A.M.O Rifat Holdings Pty Ltd v Dib [2026] VSCA 124 and what it means for builders pursuing quantum meruit claims. The decision provides important guidance following Mann v Paterson, particularly on the evidence required to establish the objective value of building work. The Court made an important distinction between what the builder spent completing the work and the actual value of the benefit received by the homeowner. The video also examines why invoices and expenditure records may not be enough, when quantity surveying or valuation evidence may be required, and the risks of using side agreements that attempt to operate outside statutory domestic building payment protections. Although the decision concerns Victorian legislation, the broader principles provide useful guidance for builders, homeowners and construction professionals across Australia. Quantum Meruit Claims for Builders: New Court Guidance on Proving Value
Construction disputes are not always decided by the contract price. In many cases, the outcome depends on the clauses buried in the terms and conditions. In this video, Damin Murdock, Principal Lawyer at Leo Lawyers, explains seven major construction contract traps that contractors, developers, principals, and subcontractors should understand before signing an agreement. The video covers contractual time bars, no damages for delay clauses, exclusions of consequential loss, nominal liquidated damages, Security of Payment legislation, prohibited pay when paid clauses, and unenforceable penalty provisions. Understanding these clauses before signing a construction contract can help preserve payment rights, manage delay exposure, and reduce the risk of costly litigation.
